ZAMBIA’S Constitutional Court has definitively ruled that former president Edgar Lungu is barred from seeking another term in office, closing the door on his planned political comeback.
Lungu, who served as president from 2015 to 2021, announced his return to active politics in 2023, sparking debate over his eligibility. However, the court clarified that his first partial term—after the death of former president Michael Sata in 2015—counts as a full term under Zambia’s constitution.
Twice elected, ineligible for future runs
‘The first respondent, Mr Edgar Chagwa Lungu, has therefore been twice elected and has twice held office,’ stated the court. ‘The constitution makes the first respondent ineligible to participate in any future elections as a presidential candidate.’
Lungu’s first term lasted from 2015 to 2016, followed by a second term from September 2016 to August 2021. He was succeeded by Hakainde Hichilema of the United Party for National Development (UPND) after losing the 2021 election.
A controversial comeback
Lungu’s return to politics came amidst legal troubles for his family. In October 2023, during a memorial service for Michael Sata, he declared his intent to re-enter the political arena. This announcement followed the arrests of several family members, including his wife, on allegations of corruption and possession of illicitly obtained property.
Despite the court ruling, the Patriotic Front (PF), Lungu’s party, has expressed dissatisfaction. ‘We are studying the matter. But we are gravely concerned by the court’s decision and ruling,’ said PF spokesperson Emmanuel Mwamba.
Heavy security at the court
Lungu did not attend the court session, which was marked by heightened security. A heavy police presence outside the court underscored the politically charged nature of the case.
This ruling not only reaffirms Zambia’s constitutional limits but also signals the end of Lungu’s aspirations for a political revival. As the nation moves forward, the focus now shifts to how the PF will regroup in the absence of its long-time leader.
