Legal Expert Flags Potential Flaw in Rivers Governor’s Impeachment Notice

A legal practitioner and public affairs analyst, Liborous Oshoma, has raised concerns over the impeachment notice served to Rivers State Governor Siminalayi Fubara, noting that addressing him as “madam” could open the door for a legal challenge.

Speaking on Arise Television on Saturday, Oshoma emphasized that the notice must be served personally to the governor. He explained, “If Fubara is addressed as ‘madam’, there might be a clerical error, but maybe at the end of the day, that also might be a ground for challenge. The notice must certainly be served personally, even though it is not explicitly spelled out in the constitution. Courts have consistently insisted that such originating documents be served directly.”

Oshoma further noted that once served, the governor has a 14-day window to respond. Regardless of whether he responds, the House of Assembly may proceed to vote on whether the matter should be investigated, underlining the constitutional procedure for impeachment processes.
